一、依據教育部 114 年 7 月 7 日臺教人(一)字第 1140070695 號書函辦理。
二、為確保公務人員依法行政、執行公正及政治中立，公務人員行政中立法第 10 條明定，公務人員對於公職人員之罷免，不得利用職務上之權力、機會或方法，要求他人不行使投票權或為一定之行使。公務員服務法第 6 條及第 20 條亦規定，公務員應公正無私、誠信清廉、謹慎勤勉，非因職務之需要，不得動用行政資源。是以，公務員於公職人員罷免案進行期間，應嚴守行政中立精神，避免利用職權或職務關係、動用行政資源或使用職銜名器從事支持或反對特定罷免案之相關政治活動或行為。
三、又各機關首長或主管人員負有管理責任，於選舉委員會公告公職人員罷免案宣告成立日起至投票日止，請禁止政黨、罷免案提議人之領銜人、被罷免人或其支持者基於宣傳、造勢或拜票等意圖所為造訪活動，且應於機關學校固定辦公或處理公務之場所各出入口明顯處所，張貼禁止支持或反對罷免活動之告示，以維政府機關行政中立之公正形象。
四、另依教育基本法第 6 條規定，教育應本中立原則，學校不得為特定政治團體從事宣傳或活動，主管教育行政機關及學校亦不得強迫學校行政人員、教師及學生參加任何政治團體或活動。
