~主旨：退休人員犯貪污治罪條例，經判刑確定而入監服刑，其三節慰問金須停止發給，請查照。
說明：
一、依據行政院人事行政總處 105 年 6 月 20 日總處給字第 1050045130 號函辦理。
二、查原行政院人事行政局 100 年 6 月 20 日局給字第 1000036800 號函規定略以，退休公務人員三節慰問金之發給，歷來均與其是否有停發月退休金、優惠存款利息之情形作一致性處理，爰合於照護規定之退休公務人員，其退休再任如有依公務人員退休法第 23 條第 1 項及第 32 條第 6 項規定須停止其領受月退休金及辦理優惠存款權利者，其三節慰問金應同時停止發給，至其再任原因消滅後恢復。
三、 105 年 5 月 13 日修正施行之公務人員退休法第 23 條增訂第 1 項第 1 款及第 3 款明定擇領或兼領月退休金人員如有犯貪污治罪條例或刑法瀆職罪章之罪而入監服刑期間，或因案被通緝期間，應停止領受月退休金之權利，至原因消滅時恢復。又同法第 32 條第 6 項規定：「支領一次退休金或養老給付，並依第 1 項規定辦理優惠存款人員，如有第 23 條及第 24 條規定應停止或喪失領受月退休金情事者，其優惠存款應同時停止辦理。……。」爰旨述人員依公務人員退休法第 23 條及第 32 條規定，應停止領受月退休金及辦理優惠存款權利，其三節慰問金自應依前開原人事行政局 100 年 6 月 20 日函規定意旨同時停止發給，至原因消滅時恢復。
