主旨：所詢教師待遇條例公布後，條例施行前過渡期間，教師取得較高學歷提出申請並已完成改敘者，得否重行核定並適用施行後之規定辦理改敘疑義一案，復如說明，請查照。
說明：
一、復貴校 105 年 6 月 8 日鹽水中人字第 1050596037 號函。
二、依據教育部 105 年 7 月 18 日臺教人(二)字第 1050086003 號函所釋，依法律不溯及既往原則，法律僅能於制定後向未來生效，並不得溯及既往對已發生之事實發生規範作用，爰公立中小學教師於待遇條例施行前取得較高學歷申請改敘經敘定薪級者，尚不得依待遇條例規定重行敘定薪級。旨揭疑義，請貴校依前開規定辦理。
