~主旨：有關長期代理教師於到職起聘日前分娩得否核予娩假一案，復如說明，請查照。
說明：
一、復貴校 105 年 8 月 16 日將軍小人字第 1050913673 號函。
二、查「臺南市中小學兼任代課及代理教師聘任補充規定」第 13 條，其給假比照行政院所屬各機關聘僱人員給假辦法辦理，合先敘明。
三、復查行政院及所屬各機關聘僱人員給假辦法第 3 條第 1 項規定略以：「...(第 4 款)因懷孕者，於分娩前，給產前假八日，得分次申請，不得保留至分娩後；分娩後，給娩假四十二日；懷孕滿二十週以上流產者，給流產假四十二日；懷孕十二週以上未滿二十週流產者，給流產假二十一日；懷孕未滿十二週流產者，給流產假十四日。娩假或流產假應一次請畢。...」同辦法第 5 條規定：「公假、例假日、曠職、年資採計及請假方式，準用公務人員請假規則之規定辦理。」
四、次查銓敘部 78 年 10 月 4 日（ 78 ）臺華法一字第 330638 號函規定略以，「女性公務人員於到職前尚未具有公務人員身分期間生產或流產，而在公務人員請假規則所定之給假期限內到職者，得依請假規則所定假期扣除自分娩或流產事實發生之日起至到職前之日數，准給剩餘日數之假期。」另參照公務人員保障暨培訓委員會 96 年 12 月 12 日公訓字第 0960013081 號書函之計算方式，分娩事實發生之日起至到職前之日數，含例假日。
