主旨：所詢貴屬約僱教練轉任專任運動教練當年度之休假日數計算及國民旅遊卡補助費核發疑義案，復如說明，請查照。
說明：
一、依據教育部體育署105年11月11日臺教體署學(一)字第1050033980號函辦理並復貴校105年11月3日大灣中人字第1051207806號函。
二、查「各級學校專任運動教練聘任管理辦法」第14條第3項規定：「教練之休假，準用學校兼任行政職務教師之規定，並以不影響訓練為原則。」另依教育部體育署102年5月28日臺教體署(一)字第1020016051號函略以，因公立學校兼任行政職務教師休假年資採計係比照公務人員規定辦理，而約聘僱人員轉任為公務人員，其原約聘僱年資得併計休假，爰專任運動教練職前曾任約聘僱人員者亦同。
三、又查行政院人事行政局77年6月11日七十七局參字第18627號函釋，約聘僱人員於本機關補實或轉任其他機關編制內公務員，年資銜接者，當年即可併計年資休假……惟於補實或轉任編制內公務人員之當年，其休假日數，應按在職月數比例核給。再查銓敘部89年12月29日（89）法二字第1975557號書函略以，約聘僱人員轉任公務人員且年資銜接者，轉任當年強制休假之實施以不重複為原則。
四、按現制約僱人員年度休假係依曆年結計，轉任專任運動教練後則改採學年度核給，兩者休假之期間不一致，為維護當事人權益及避免重複核給休假，並參酌上揭規定，有關約僱教練轉任專任運動教練當年度之休假日數應按調任後當年月數比例核給休假。但於調任前已休假日數未達該學年在職月數比例應休假日數者，其未休假日數，准予保留至調任後實施休假。以具約僱年資滿14年以上人員為例，約僱運動教練105年度可休慰勞假30日，若該教練於105年9月起轉任他校專任運動教練，並於轉任前業已休畢慰勞假18日，則其調任前任約僱運動教練105年度休假及專任運動教練105學年度之休假日按在職月數比例((30×8/12)+(30×11/12))，合計應為=47.5日，扣除已實施之慰勞假，得再核予29.5日休假。
五、本局教育公告系統105年10月6日第95535號公告「105年臺南市增聘專任運動教練學校相關提問彙整表」，編號一「職前年資提敘」學校提問6中，有關休假計算部分停止適用。
六、另國民旅遊卡補助費核發乙節，請依上開105年臺南市增聘專任運動教練學校相關提問彙整表回覆說明，約僱運動教練之休假係以年度核算，其轉任專任運動教練後則係以學年度核算，並以不重複核發為原則。
