主旨：有關公立國民小學教師職前曾任公務人員年資採計提敘相關疑義一案，請查照。
說明：
一、函轉教育部 106 年 2 月 17 日臺教人(二)字第 1050174135 號函。
二、有關公立學校教師職前曾任公務人員試用期間之年資得否採計提敘薪級，及教師待遇條例（以下簡稱待遇條例）第 9 條規定所稱按年採計提敘，是否按辦理考績（成）年度予以採計提敘等疑義，依教師職前年資採計提敘辦法第 3 條及第 4 條規定，教師職前曾任銓敘或登記有案之公務人員等級相當之年資，需符合年終考績列乙等或 70 分以上，繳有證明文件，始得按年採計提敘薪級。是以，公務人員於考績年度內試用期滿並依規定辦理年終考績，考績列乙等或 70 分以上，當年度等級相當之試用期間年資，於嗣後擔任公立學校教師時，得依規定按年採計提敘薪級。
三、至有關教師職前曾任銓敘有案公務人員，其任教師所敘薪級若低於原經銓敘審定有案之俸級，得否依原銓敘之俸級核敘疑義，依待遇條例規定，初任教師薪級之核敘，應依該條例第 8 條規定起敘，並依第 9 條規定採計職前年資提敘薪級。教育部 80 年 5 月 9 日台（ 80 ）人字 22515 號書函有關一般行政機關公務人員轉任各級公立學校教師得依原銓敘之俸級核敘之規定，因與待遇條例規定未符，教育部業以 106 年 2 月 7 日臺教人(二)字第 1060004715 號函停止適用。
