說明：
一、依公務人員行政中立法（以下簡稱中立法）第 10 條規定：「公務人員對於公職人員之選舉、罷免或公民投票，不得利用職務上之權力、機會或方法，要求他人不行使投票權或為一定之行使。」同法施行細則第 7 條規定：「本法第 10 條公務人員對於公民投票，不得利用職務上之權力、機會或方法，要求他人不行使投票權或為一定行使之規定，包括提案或不提案、連署或不連署之行為。」
二、次依中立法第 9 條規定：「（第 1 項）公務人員不得為支持或反對特定之政黨、其他政治團體或公職候選人，從事下列政治活動或行為：一、動用行政資源編印製、散發、張貼文書、圖畫、其他宣傳品或辦理相關活動。……（第 2 項）前項第 1 款所稱行政資源，指行政上可支配運用之公
物、公款、場所、房舍及人力等資源。……」揆其意旨，係考量公務人員應注意其身分之特殊性，並考慮其職務上之義務，對政治活動應自制，應保持中立之態度，爰具體規定公務人員不得從事之政治活動或行為，並明定所稱「行政資源」之範疇，以期明確。復依公務員服務法（以
下簡稱服務法）第 5 條及第 19 條規定，公務員應謹慎勤勉，且非因職務之需要，不得動用公物。
三、茲以公務人員應忠實推行政府政策，服務人民。對於公投案自應保持行政中立，依服務法第 5 條、第 19 條及中立法整體規範意旨，公務人員除應遵守中立法第 10 條及同法施行細則第 7 條規定外，亦不得「動用行政資源」、「利用職務關係」、「影響公務執行」或「使用職銜名器」支持或反對特定公民投票案（包含公投之提案、連署及投票）；又參照中立法第 9 條第 2 項規定，所稱行政資源，係包括行政上可支配運用之公物、公款、場所、房舍及人力等。
